Direct Procurement – Exemption 16

Under Exemption 16 of the Commonwealth Procurement Rules, government departments and entities may procure goods and services directly from Indigenous SMEs without undertaking a full open market process.

Provided the agency can demonstrate value for money and obtain the appropriate internal approvals, procurement can occur for projects of any value.

This pathway is commonly used when:

  • Specialist capability is required

  • Procurement needs to occur quickly

  • Agencies want to support Indigenous participation outcomes

Mandatory Set Aside (MSA)

The IPP includes a Mandatory Set Aside which requires Indigenous businesses to be given the opportunity to demonstrate value for money before going to the open market when:

  • Procurements are valued between $80,000 and $200,000 (GST inclusive), or

  • The project is delivered in remote Australia.
